Pending before the Connecticut General Assembly is proposed legislation that would bypass both State and Federal Constitutional protections and deny people their right to due process. The way the bill is written, a third party — your dry cleaner, your car repair person, your credit card company, etc. — can receive a subpoena to produce your property and private information in their control to the prosecutor and there is no requirement to notify you of the subpoena at all: The property in which you have an interest can be handed over to the state without a hearing, let alone a hearing that you are aware of or invited to attend to protect your interests. This bill is an unconstitutional legislative effort to sidestep the Fourth Amendment of the United States Constitution.
