A three-judge panel of the U.S. Court of Appeals in New York indicated some skepticism that a student can be punished in school for Internet activity from home. At issue was an appeal by Avery Doninger, the 17-year-old Burlington high school senior who was denied election as class secretary because of comments she had posted on her livejournal.com weblog about a planned school musical event. “Jamfest is canceled due to the douchbags [sic] in central office,” she wrote, and encouraged others to write or call the principal "to piss her off more." Attorney Jon Schoenhorn argued on Doninger’s behalf that students have a free-speech, First Amendment right to comment, even offensive comment, when away from school and not using school facilities.
