A habeas corpus action requires the government to prove that it is legally incarcerating a person. This is an incredibly powerful and important action for an incarcerated person to have at their dispense, as it can help to end a wrongful incarceration and ensure justice. As a result, it is important to keep this legal action readily available to incarcerated people. As this bill's goal is to reduce "frivolous" habeas corpus applications, the ACLU-CT believes this bill is unnecessary, and we oppose its passage.
